The EB-5 Reform and Integrity Act (RIA) introduced changes, but the impact on investors, particularly pre-RIA investors, remains unclear. AIIA raises questions about investment period, sustainment requirements, and the effect of regional center terminations.
Last week, the American Immigrant Investor Alliance submitted a question and comment packet to USCIS ahead of its March 20 EB-5 Stakeholder Engagement. The agency announced the engagement on January 30 and stakeholders had until 4pm ET on February 10 to submit their questions and comments.
AIIA compiled comments pertaining to the topics USCIS proposed for the March engagement: Direct and Third-Party Promoters, Sustainment/Investment Period, and Regional Center Operations. Our full response is available for all EB-5 investors and industry stakeholders to review.
We encourage all investors and AIIA community members to register for the March 20 engagement to hear first hand from the agency how the plan to modify sustainment periods, and account for pre and post-RIA investors.
